Recently, we had the opportunity to interview Steven Toushin of Chicago’s infamous Bijou Theater.

How did you get started in porn?
How I got started is a story. It was in 1966 that I started traveling and working my way around the country, it was in the summer of 1968 that I stopped in Chicago. I meant to stay a few weeks, but I ended up getting a job managing a theater. The theater was called the Aardvark, it was located in Pipers Ally in Old Town.
The Aardvark Theater showed avant-garde, experimental, and documentary films and at times classic when it could afford them. All of the films that were shown were little-known films that produced modest returns. Many of these films played at college film festivals and art houses, some examples are Titicut Follies, about life inside a Massachusetts institution for mentally ill criminals. Kenneth Angers Scorpio Raising, The Queen (about a drag queen contest), Bob Dylan’s documentary called Don’t Look Back and films that had nudity. Nudity did extremely well at the box office.
It was in1969 that I played Jack Smiths ‘Flaming Creatures’; this was a gay themed film that had nudity. The city didn’t like Flaming Creatures, this became my first obscenity bust. Then in 1970, right before the beginning of the hardcore X-rated film era, I became the working partner of the group that I was originally working for, at that time there were now three theaters in the company. The opportunity presented itself to show a well-known commercial film with a dubious reputation and legal history called I Am Curious Yellow. I jumped at the opportunity without a second thought, Yellow was my second obscenity arrest, this took place at the Festival theater in Indianapolis (our third theater).
I felt the arrest for showing Flaming Creatures was absurd. It didn’t hurt or cause anyone any harm, so why was the film a problem? You had to be over the age of eighteen to see it, and besides you had the choice to see it or not. I was annoyed “Who the fuck are these people? I didn’t like the fact that there were people who were dictating their views, their ideas of right and wrong on me. My feeling is simple, what they were doing was wrong, they should not have control over expression, over speech. They should not have the ability to punish others that do not have the same point of view as them.
So now I have been arrested twice for obscenity. Yes I knew the legal consequences for my actions, I wasn’t concerned about my reputation, I didn’t comprehend the idea of censorship in a free society, people wanted to see these films and these films made money. Since I wasn’t fearful of being arrested I made the decision that lead to my full time involvement in the adult Industry. It was in 1970 that the first commercial hardcore xxx-rated pornographic sex film (that’s a long introduction for introducing porn) became available, that was the year that I began exhibiting adult films both straight and gay. That first film was Alex DeRenzy’s “Pornography in Denmark”: A New Approach (aka “Censorship in Denmark” aka “Denmark Without Censorship” IMDB) in Chicago and Indianapolis, the film was also playing at the time in New York, San Francisco, and Los Angeles.
I asked you how you got started in porn, now I want to know why you got involved in porn, other then for money? You knew there were going to be legal problems with the police, and federal government for being in the porn business, especially gay porn. So why take a chance and go through the legal hassles besides risking your freedom?
As it turned out money was not my primary motive for being in the adult business. Life would have been better if I was more conservative and cautious in my thinking, because I certainly pissed a away a lot of money in legal fee’s and lost business opportunities fighting the government. Of course I knew of the problems, I had already been busted twice (certain obscenity’s charges are criminal felonies), in fact during my second bust (I wasn’t in the porn business yet) I found myself in two other court rooms defending civil charges that were directly related to the obscenity bust. The focus for the intensified legal problems was to put as much pressure on me as possible, so as to get me to plea bargain. The deal I was offered was that the criminal charges would be dropped to a misdemeanor and I had to close the theater. If I didn’t accept and continued to trial and lost, then the state were going to push for the maximum prison sentence, which all the attorney’s (state and my defense team) felt I would receive with this trial judge.
I didn’t take the deal. I can honestly say that I strongly believe, as foolish as it may seem, (as I said before) that I do not like others dictating their beliefs on me, especially when those beliefs do not make any sense, and when they are self serving. I wasn’t going to tolerate it then, and I do not tolerate it now. Again all this was before I decided to entered the porn business.
Later when I decided my business and career were going to be in the sexual world, without question I knew what the problems were going to be for both the business and myself, I already had the history that taught me that. But once the decision was made, the personal consequences became immaterial. I have never make a big issue of the problems and risks; I accepted them as just another part of being in the sex business, the consequences were the cost of doing business.
One last thing, I normally keep my views and opinions to myself. I’m not trying to change the world; I’m not loud about my beliefs; I don’t preach them to others; and I don’t inflict them on others. When it came to defending myself in court, it was always my fight. I didn’t ask others for help and, in fact, I very rarely told anyone about the legal problems. I felt it wasn’t anyone’s business and in truth, people don’t give a shit about anything other then themselves. So as I see it, I am responsible for my decisions and actions; and I will take care of my problems.
The Bijou is the oldest gay theater and longest continuing operated gay production company – how did theater survive for over 40 years in the business?
Legally I fought all the arrests, licensing, health and zoning problems that the city, state and federal government threw at me. But then there was the horrible problem of AIDS, within the community, and the city. As far as the Bijou dealing with the AIDS situation (1980’s-1990’s), it was the strength of Chicago’s gay community that the city let the adult business stay open without much hassle and worked with all the sex businesses in getting out HIV information to the gay community. Everyone agreed that it was better to let the sex place’s stay open so they could dispense HIV information and condoms, then to drive all those men into the parks, ally’s, public bathrooms, etc where it would be absolutely unsafe. Of course there were people who were going to go these place’s anyway but for the most part the strategy worked, it was good for gay men and the community.
The Bijou theater survived as a sex club because of the different levels of business that combined porn, sex shows and most importantly an interesting place for men to meet and have sex. Now keeping the name out there nationally was done through years of advertising through Bijou Video’s Mail-order Company always plugging the Bijou theater in Chicago. There was also the making and distribution of Bijou’s films, that got Bijou theater’s name (a trailer advertising the theater was in the beginning of each film) out nationally and internationally to the viewer. I also include in all print advertisements reference’s to the theater.
Also the theater is in Chicago a major city that caters to the local gay and bi community, as well as to gay man that live in the surrounding area’s and cities, as well as the tourism and convention business. Since the theater first opened the Bijou has established itself as a place to go to for sexual entertainment for gay men.
And lastly I also feel an important aspect of Bijou’s longevity is the respect we have for sexuality, gay sexuality; and all sexual needs, desires and fetishes. Respecting gay men no matter where they live, small town, suburbs, large city or long time out, a new puppy or closeted.
How did you survive over 40 years in the business?
I have no clue how I survived, I have to say I have made some pretty stupid decisions; that a sane, rational person would not have made. But those choices were based on what I believed in and what others more powerful than I didn’t want to exist; my decisions have always had their consequences. So the question I have always asked myself is “What am I willing to sacrifice for my principles”. The answer has always been everything.
(Some history on the consequences of my decisions. I have been in the court and federal system daily for 40 years, it has cost me a fortune in legal fees and lost business revenues. I have been arrested 35 times, my businesses over 200 busts and spent years preparing for trials. I have been to prison twice and sacrificed time with my family. These are just some of the highlights – 1989 Federal obscenity trial)
I choose not to allow the government or others to tell me that my business of gay sexuality, sexuality in general, my principles were wrong, I have harmed no one. Yet I have witnessed like many others the government’s prejudice against gay men and women. Those self-righteous people in Government, along with religious social conservatives who apposed gay sexuality for their self-interests, were the ones who are viciously harming multitudes of good people and society as a whole.
I survived because I always felt gay sexuality in film was more than idolizing white bread. To begin with Latin’s are sexy, bears are sexy, blacks are sexy, Asian’s are sexy, any and all body type’s, ethnic, daddies, fetish, S/M are sexy. Fantasies should not be discriminated against, I was the first to bring many of these genre’s to the wholesale market when everyone told me it’s all about white bread.
I survived because I thoroughly enjoy sexuality; I truly enjoy and believe in what I do, I truly enjoy thinking about the history and future of sexually. I believe in what I am making, selling, writing, creating. I believe that the Adult industry is an integral part of society, I believe that gay sexuality is an integral part of a healthy society.
What would you have done differently?
Nothing, to have done anything differently in my business and life would mean that my life would have turned out differently. I am very proud of most things I’ve done, even some of the foolish decisions I’ve made. There is no question that the average person would not have chosen, made many of the decisions that I made, but they were my decisions, my choices based on my principles and philosophy of life, and I would not change anyone of them. That’s not to say that there are not some decisions that I regret making. One in particular was not attending a dear friends funeral, another was allowing people I trusted fuck me over.
What is your greatest achievement?
Standing by what I believed in, no matter how many times I was prosecuted or demonized by the government and press. Standing by my principles even though at times it was not the wisest, smartest, and without question not the most convenient or the healthiest thing to do for my life and family. It is easy to stand by principles when they are not being tested, when they are issues of theory, and bravado. But when those situations come that tests your principles, your beliefs, you realize there is without question a price to be paid for holding on to them; for those fearful consequences are staring you right in the face. These are the moments when you realize what your values truly are, what you will sacrifice for your values. This is when you know what your self worth really is.
Do we need obscenity laws?
I’m going to take some time on this question. No, obscenity/pornography/sexuality laws stem from moral law instituted thousands of years ago by the church to maintain control over good people as well as to be profitable. How do you control good people who would never desire to break society’s criminal laws? By creating morality/sexual law that controls the natural sexual urges, desires, needs, habits of all people for profit.
So as stated by the church “Relationships, sexual relationships between the sex’s is wholesome and happily founded upon the true moral and spiritual ideals that function in harmony and obedience to the bible, prayer and our Father in Heaven, anything other is sordid and immoral.” The original purpose for the regulation of Morality was for the church to make money at the collection box (absolution of sin, impure thoughts). This was an ingenious way to control and profit from all good people. Government picked up the banner of morality so as to have other means to control society on a daily bases when needed through ridicule and punishment.
A good test for the need of morality law is to look up how many children/people have gone out and sexually molested others after reading playboy or viewing a porn film over the last 50 years. The answer is none. Looking at the Internet era where porn is available to anyone with a computer (and now a smart phone). How many people have gone out after viewing porn and sexually attacked, abused, or maimed another person. The answer is none. Porn is the destroyer of women, children family, communities, great line, wrong. Obscenity, pornography/sexuality harms no one, yet has the ability to relieve tension as well as give personal satisfaction. The pleasures we derive from sex is gods gift to humanity.
(A side note, what about this new dreaded disease called porn addiction? This disease/term was created by social conservative’s to fight porn from the medical prospective. This new disease gives them a new angle to rally up their legions of followers, by the way the only information you will find on this subject are books and articles written from the religious, and social conservative point of view. This new disease also give’s these groups a new revenue stream in donations and enlists legislators giving them the medical angle to vote anti porn/sexuality. The social conservatives agenda has now expanded from porn, sexuality, abortion, homosexuality, gay marriage and now the newly adopted porn addiction.
Back to your question, “Do we need Obscenity laws”, NO we don’t need obscenity laws in our free society, its only purpose is for the few to control the many when needed. Obscenity is quite unique; it’s the only crime, if it is a crime, cannot be defined by law. Murder there’s a body, robbery something is taken without permission, cocaine chemical make-up, these crimes and drugs are defined, porn not defined. Case in point the Supreme Court has avoided defining what is obscenity in film, book, drawing, photograph (for this discussion I will use film). What the court has done is allow the government to bring criminal charges based on personal opinion, religious beliefs and political motivation. When someone with authority in government decides a film violates their sense of morality, the film or films are brought in front of a Grand Jury which will automatically indict for obscenity. Then a Judge is assigned and a jury of 12 people are chosen (this is the condensed version of the legal process leading to trial).
Now these 12 people (jurors) bring with them their views, fears, prejudices, religious beliefs, what ever worldly knowledge they posses and their healthy attitudes about sex or their fears and phobia’s about sex. All this stuff goes into their decision if what they viewed is criminal or not. The prosecution states the films have violated the obscenity laws (Miller 1973), and moral decency. The defense states porn is prevalent in our society, that we have choice to view it or not, and besides there’s first amendment protection issues (I’ve streamlined the strategies to made this simple). Now we’re asking each member of the jury to combine personal, sexual and constitutional prospective so as to render their decision.
The last part of the process is the verdict in-which there can be three different decisions, guilty, not guilty or a hung jury. You can bring in six different jury’s and get any number of different verdicts with the same films. There can also be different out comes with different prosecutors and defense attorney’s. Obscenity, what might be found obscene in rural Tennessee, might not be found obscene in Nashville Tennessee and most likely will not be found obscene in New York, Miami, or Chicago (obscenity trials very rarely take place in major cities).
But the real problem in repealing the obscenity, morality laws, is that the Supreme court does not want to give people, society total freedom of speech and expression. Government and the religious do not want to give up the power, control and money they have enjoyed for thousands of years. They will not tolerate losing control, they will fight to the end to keep obscenity/sexual laws in place. The repeal of the sodomy laws are killing the religious and social conservatives. Today the Internet with it’s millions of pages of porn porn has rendered the obscenity laws mute.
Who are affected by the law? The laws really effect the average person not pornographers. A school teacher that mistakenly has a scantily clad person pop up on their school computer-monitor in front of a classroom full of children. So a parent complains and the teacher could be fired or criminal charges could be brought against the teacher. A theater company or some business like Abercrombie and Fitch that would create a provocative poster that someone objects to and calls the local authorities. What about an Art Gallery or a museum exhibit that some people feel is obscene and should not be viewed by the general public.
Did you have a role model?
I’ve never had a role model though there are people I have greatly admired. I have always admired individuals that had the intelligence; fortitude of character and passion to pursue what they believed in no matter what the odds were against them or how unpopular the course (not a repressive cause), the passion in following ones dreams, to pursue new idea’s, the need to accomplish to become the best at what they do.
These people are Barry Scheck the Innocence Project, Jefferson, Madison, Hamilton, Franklin for their progressive thinking, imagination, passion and intelligence in creating a new form of government by people for people. The structure and philosophy that formed America was a very progressive, liberal experiment. I am enamored on their fortitude of character to buck the history of mankind to proclaim America’s social contract around Life, Liberty and the Pursuit of Happiness as a concept that most people today have trouble comprehending.
What and who do you think is the greatest threat to free speech?
The greatest threat always comes from politicians, from repressive politics, from the Religious, from bigotry, from social conservatives. from government that needs to quash dissent and those who need to control others. The greatest threat has always been statements, expression, ideas that those in control or those that want to be in control don’t agree with or renders criticism.
Control means the limitation or the elimination of choice with the threat of punishment when control is violated. Freedom means choice, which includes the acceptance of idea’s, political ideas, speech, and expression that is offensive, distasteful, not mainstream acceptable. Free speech includes any and all extreme ideologies from the right and left from hate, to sexual, etc. The greatest threat to the American republic and to free speech is from a combination of the self righteous, Government, the religious, the social conservatives, conservatives without conscious, the ignorant and those that are terrified, fearful of others that are different then themselves and from idea’s and concepts they do not understand.
What do you think of the porn companies you see today?
The Industry philosophy has changed from decade to decade, the adult industry keeps evolving as technology and communication keeps developing. Through technology the Internet has opened up the never-ending parade of porn that has made it easier for anyone to bring porn to the public without needing the old system of limited video, magazine distribution. Because of the Internet there are a multitude of sexual fantasies and every body type and ethic group imaginable presented for every sexual desire. This is fantastic.
But the problem is that a good deal of today’s porn is junk. Yes there is some is good, and some excellent porn, but there’s no hiding the fact there is a lack of sexual heat generated, chemistry between performers.
When I first started in porn most filmmakers tried to be relevant in the fantasies they created with good sex. That doesn’t mean that every film was good. There was cheap uninspired porn, there was plenty of crappy one room wonders. Today many films are individual scenes strung together to make an hour film, many of these are still cheap one-room wonders. Over the last 20 years porn has morphed into narcissistic porn. There’s nothing wrong with narcissism, some of it is really good but it’s purpose and appeal is for the viewer to admire the models where the sex itself may not be very good.
Also because it’s so easy and cheap to make a porn film, build a website and get whatever you’ve made on a VOD site, it’s truly all about the money. There is nothing wrong with money, but there doesn’t seem to be any concern about the customer or respect for gay sexuality. Lastly the adult Industry is a clone of itself, it is the most uncreative Industry in the world. What ever sells in fantasy, body type, sex, film style, will be recreated/cloned within 24 hours by a hundred different people who will dump 100′s of hours of sameness into the market place. A month later there’s now thousand’s of hours of clone in the market place, for most people it’s all about quick and cheap. (quick and cheap I like that for a film title)
What is your opinion of bare backing?
My rules for sex are very simple you can do anything you want, meaning no limits as long as there are no children, no permanent harm, you can’t fuck the animal but the animal can fuck you and there must be mutual consent for what you want to do. Barebacking violates permanent harm.
Barebacking is all about money, strictly money no consideration for the performers, no thought about health with the mixing of HIV strains contaminated with drugs. For some companies the emphases is on someone being a cum-dump (under better times I like this) which reinforces the mixing of strains. Later on when that cum-dump performer is having unprotected sex off the set the spreading of HIV becomes extremely dangerous. As far as good sex is concerned most barebacking are just clinical close-ups to emphasize no condoms, the concept of good sex is immaterial.
The tragedy as I see barebacking is that the filmmakers have no thought about being responsible to the performers or the viewing public and can justify the making of these films with the stupidest of reasoning. But as long as the viewing pubic wants the product distributors, VOD sites and retailers will demand and provide the product.
So to answer you question, I don’t like it, I know how, why and when barebacking came about. The Bijou’s policy is I do not sell barebacking films in any of my companies and I do not exhibit barebacking films at the theater. I have an anti barebacking statement that I’ve had on my website since 2004, which I also sent out to the press in 2005. Barebacking does not include pre-condom films which are called pre-condom, classic or vintage.
One last thing, the owner of the company that first came out with barebacking films (that company coined the phrase barebacking and the year was 1999) died this year
What do you want to be remembered for?
For my participation in the creation of both the modern adult Industry and the gay adult Industry. For standing up and taking responsibility for what I believe in. If possible for making society understand, acknowledge and accept the importance of all aspects of sexuality, gay sexuality, S/M, sexual expression without restrictions, choice without restrictions, human equality without restrictions. I would like to be remember for making some contribution to society, my way. That would be fabulous.
